When you’re going the Social Security disability application process alone, the easiest—and most common—problem that our clients describe is missing deadlines. Whether it’s your last chance to file an appeal or the point at which your monthly benefit will be garnished to balance an overpayment, the SSA will alert you to a pending deadline in the notice that they send about the matter.

About Social Security Deadlines

Don’t make the mistake of thinking that the clock starts ticking on a deadline the moment you receive a notice. Social Security deadlines start from the date printed on the notification.

If the notice giving you 30 days to deal with an issue is received on November 11th, but dated November 1st, you will have until November 30th—not December 11th—to take action. That’s true even when a notification gets lost in the mail.

It’s a small window of time, and it goes by faster than you’d think.

One of the things a Lincoln disability attorney can do for you is ensure your case isn’t stalled out by a missed filing deadline. However, if you’re already a few steps into the process and have missed a deadline, we may be able to help you work the matter out with the SSA, or at least help you build a stronger case if you must start over from scratch.
