After an initial application for veterans' disability benefits has been denied, an individual may be left wondering what his or her options are, and if they have any. It is important to note that you have the right to appeal the denial of your VA disability claim.

Once your initial application has been submitted to your local regional VA office, the application will be reviewed and a decision will be made. You will receive this, officially called a "Ratings Decision." If this Ratings Decision does not meet your satisfaction, you are able to file an official Notice of Disagreement with the same office. You have only one year to file this notice of disagreement, so it is essential to take action as soon as possible after receiving your Ratings Decision.

From this point, a number of things happen, including:

  • Request for a personal hearing and case review by a Decision Review Officer at the local VA office
  • Submitting an appeal to the Board of Veterans' Appeals (BVA)
  • Receipt of decision from the Board of Veterans' Appeals

Further Appeal

After this entire process, if you are still dissatisfied with the decisions that have been made regarding your VA disability claim, a final appeal may be made to the United States Court of Appeals for Veterans' Claims. This appeal must be filed within 120 after a decision from the Board of Veterans' Appeals.
